INFORMATION NOTICE REGARDING THE PROCESSING OF PERSONAL AND SPECIAL DATA

Maesina Marketing Search Italia Srl in compliance with the provisions of Articles 13 and 14 of European Regulation (EU) 2016/679 (hereinafter also GDPR) and Legislative Decree No. 196 of June 30, 2003, as amended by Legislative Decree No. 101 of August 10, 2018, hereby provides the information relevant to the purposes, methods and scope of communication and diffusion of personal and/or special data provided by candidates through website registration in the area “Candidates” via email.

Maesina Marketing Search Italia Srl may, should the need arise and/or required by current legislation, modify this Privacy Policy by providing you with notice through our Services, to give you the opportunity to learn about the changes before they become effective. Should you decide not to expressly consent to the changes, you may at the same time proceed to request the data’s cancellation pursuant to and in accordance with Article 19 of the GDPR.

In the event that you do not exercise your right of withdrawal and that of cancellation or limitation of the processing of your data pursuant to and for the purposes of Article 19, you expressly agree that the processing of your personal data will be carried out in the manner, purpose and terms provided in this notice.

 

1. Type and classification of collected data collected

At the same time as creating the account and adding Curriculm Vitae and Cover Letter you will provide Maesina Marketing Search Italia Srl with your personal and special data as detailed below:

  • biographical data;
  • photographs;
  • data to reveal your state of health,
  • data related to your residence/domicile in real time
  • information related to the performance of work, such as the type of contract, qualification, professional level, individual salary

Such data may also be processed by the members of the system (as detailed below) for the purposes specific to the service offered in order to facilitate the matching of labour supply and demand.

As anticipated above, when processing your data, Maesina Marketing Search Italia Srl may become aware of special categories of personal data (also “special data”). We refer to data likely to reveal racial or ethnic origin or data related to health.

Also in this regard, we confirm that your “special data” will be treated with the utmost confidentiality and in full compliance with current legislation as well as the provisions of the Supervisor’s General Authorization.

Data collection Your personal data will be collected by Maesina Marketing Search Italia Srl through registration in the area or by means of sending an email to maesina@maesina.it
User profiling When you provide the data referred to in this policy, Maesina Marketing Search Italia Srl will create a user profile in line with the information you provided during the creation of your account in order to facilitate the matching of supply and demand.

We will process the data for these purposes only in the event of your consent, which is optional and revocable at any time (Art. 6.1(a) GDPR).

Additional data Data may be collected such as:

  • the frequency of access to our website/portal,
  • the type of actions performed while browsing;
  • IP address, browser, timestamp/time.

This information will allow us to simplify the use of the website/Portal in the future, including through the proposal of assignments in line with the professional profile or displayed on the site.

Additional data that may be collected will be, for example: data related to disabilities and specific pathologies that entitle to legal benefits).

 

2. Purpose Of Processing and Information Sharing.

Your data will be processed both in case of application in response to a specific advertisement and in case of voluntary application for the pursuit of the purpose of search and selection of candidates, in particular:

  • for direct job placement at our client company
  • for direct job placement at Maesina Marketing Search Italia Srl

Your data are also processed to send you service communications strictly related to the purpose of search and selection of candidates by traditional or automated contact methods.

Your data will be shared with our client companies to enable you to find a job more easily or help you during your job search.

In addition, your data will be shared with the manager of digital data storage services who will process it based on the instructions received from Maesina Marketing Search Italia Srl.

Data, including special data, may be transferred abroad to countries belonging or not belonging to the European Union. Any transfer of your data to Companies established in countries outside the European Union will be conducted in full compliance with the requirements dictated in this regard by Articles 44 et seq. of the GDPR, in a manner that ensures adequate safeguards, including with reference to the rights that you may have.

 

3. Data Retention Period

In the case of data processing for the above-mentioned purposes, the data will be entered into the database named Maesina present on the management system in website Ezekia.com and kept for 24 months from their entry, i.e. from your last interaction with the WebSite (updating your data or uploading your resume) or in any case you do not exercise your right to withdraw your consent and/or delete them (1). Once the above retention periods have expired, the data will be destroyed.

In addition, data related to Maesina Marketing Search Italia Srl will be kept for a maximum period of 5 years for the purposes described above and to allow Maesina Marketing Search Italia Srl to maintain a stable network of contacts such as to facilitate the matching of supply and demand in the labor market (2). In any case, this is without prejudice to your right to revoke your consent and/or delete them.

 

4. Processing procedures

The data’s processing is carried out both in automated and manual form in compliance with the provisions of Article 32 of G.D.P.R. 2016/679, by specially appointed individuals and in compliance with the provisions of Article 29 of G.D.P.R. 2016/679. We inform you that, in compliance with the principles of lawfulness, purpose limitation and data minimization, pursuant to art. 5 of G.D.P.R. 2016/679, subject to your free and explicit consent expressed in this notice, your personal data will be kept for the period of time indicated in the preceding paragraph.

 

5. Data Processors and chosen person in order to the data’s treatment.

Your data may be processed exclusively by employees of Maesina Marketing Search Italia Srl and people who hold the corporate functions authorized to process them as they are deputed to the pursuit of the aforementioned purposes (such as, for example, Human Resource Managers). We confirm that the above-mentioned people have received the necessary training for the proper processing of data and adequate operational instructions.

Your personal data may also be processed by external parties, expressly appointed as data processors, who provide Maesina Marketing Search Italia Srl:

  • Site management and maintenance services;
  • Candidate database management and maintenance services;
  • Market researching.

6. Rights of the data subject

In relation to the data subject to the processing referred to in this notice to you, as a data subject, are recognized at any time the right to:

7. Withdrawal of consent to processing, without prejudice to the lawfulness of the processing based on the consent obtained before the withdrawal (Art. 7(3) EU Regulation No. 2016/679);
8. Complaint to the Data Protection Supervisor Authority (Art. 51 EU Regulation No. 2016/679).

 

7. Withdrawl of Consent

You have the right to revoke the consents you have given at any time by sending an e-mail communication to Maesina Marketing Search Italia Srl.

The withdrawl does not affect the lawfulness of processing based on the consent you gave before your revocation.

 

Contact details for the exercise of rights

We also inform you that you may exercise all further rights set forth in Articles 15 to 22 of the GDPR by written request to be sent to Maesina Marketing Search Italia Srl as Data Controller. In particular, the current legislation on the processing of personal data gives the data subject the right to access his or her personal data (and related information) and to have confirmation as to whether or not such data is being processed and knowledge of the origin of the data as well as the logic and purposes of the processing.
